1. Introduction

Welcome to The Rotation. By accessing or using The Rotation's website, mobile application, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any community guidelines we may publish. Please read these documents carefully before using the Service.

We may update these Terms from time to time. We will post the updated Terms on this page with a new effective date. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. If you do not agree to these Terms, do not use the Service.

2. Eligibility and Account

2a. Eligibility

You must meet all of the following requirements to use the Service. By using the Service, you represent and warrant that:

• You are at least 18 years of age;
• You are legally qualified to enter a binding contract;
• You are not prohibited by law from using the Service;
• You have not been convicted of or pled no contest to any crime involving violence, the threat of violence, or sexual misconduct;
• You are not required to register as a sex offender;
• You have not previously been removed from the Service unless we have given you express permission to create a new account.

If you cease to meet these requirements, your authorization to use the Service is automatically revoked and you must stop using the Service immediately.

2b. Your Responsibilities

You agree to:

• Provide accurate information and keep your account information up to date;
• Comply with these Terms and all applicable laws;
• Treat other users with respect, both on and off the Service;
• Protect the security of your account and login information;
• Use your best judgment when interacting with others and meeting in person.

3. Prohibited Conduct

You agree that you will not:

• Misrepresent your identity, age, or any other information;
• Harass, bully, stalk, intimidate, assault, defame, harm, or mistreat any person;
• Use the Service for any harmful, illegal, or fraudulent purpose;
• Solicit money or items of value from other users;
• Share your account with another person or use another user's account;
• Post or share content that harasses, threatens, discriminates, or promotes hatred or violence;
• Post obscene, pornographic, or sexually explicit content;
• Post content that infringes another person's intellectual property or privacy rights;
• Post content that includes another person's image or likeness without their consent;
• Use the Service for commercial purposes, advertising, or spam;
• Use automated means (bots, scrapers, etc.) to access the Service;
• Attempt to circumvent any security or access controls;
• Reverse engineer, decompile, or disassemble any part of the Service.

Violation of these rules may result in immediate suspension or termination of your account.

4. Content

4a. Your Content

You are solely responsible for the content you post, including your profile, photos, bio, and messages ("Your Content"). You represent that you have all necessary rights to post Your Content and that it does not violate these Terms or any third party's rights.

By posting Your Content, you grant The Rotation a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and distribute Your Content in connection with operating and providing the Service. This license continues for a reasonable period after you delete content to allow for technical processing (e.g., backups).

We may remove, edit, or block any of Your Content at any time for any reason, including if we believe it violates these Terms or is harmful to other users.

4b. Other Users' Content

Content posted by other users ("Member Content") belongs to them. You may not copy, distribute, or use Member Content for any purpose other than as intended by the Service (e.g., viewing profiles, communicating through the Service). We do not guarantee the accuracy or appropriateness of Member Content.

5. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

6. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. This license is automatically revoked if you violate these Terms.

7. Account Termination

You may delete your account at any time through the Service settings. We reserve the right to suspend or terminate your account at any time, without notice, if we believe you have violated these Terms, misused the Service, or behaved in a way we regard as inappropriate or unlawful.

If your account is terminated, these Terms continue to apply. We may retain certain information as described in our Privacy Policy.

To the fullest extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. We do not guarantee the accuracy, completeness, or appropriateness of any content on the Service. We are not responsible for the conduct of any user or for any content posted by users.

10. Limitation of Liability

To the fullest extent permitted by law, The Rotation and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service, your interactions with other users, or any content on the Service.

Our total liability to you for any claims arising from or related to the Service shall not exceed one hundred dollars ($100 USD) or the amount you paid us, if any, in the twelve months preceding the claim, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

11. Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless The Rotation and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, your conduct toward other users, or your violation of these Terms.

12. Dispute Resolution

If you have a dispute with us, we encourage you to contact us first to try to resolve it informally. You may send a written notice describing your dispute to the contact information below.

Any dispute that cannot be resolved informally shall be resolved by binding individual arbitration, except that either party may elect to bring an individual claim in small claims court if the claim qualifies. You and we each waive the right to a jury trial and the right to participate in a class action. These dispute resolution provisions are governed by the Federal Arbitration Act.

If any part of this dispute resolution section is found to be unenforceable, the remainder shall remain in effect.

13. Governing Law

These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles. Any legal action or proceeding shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts.

For users in the European Union, United Kingdom, or other jurisdictions where the above is not permitted, the laws of your country of residence may apply, and you may have additional rights under local consumer protection laws.

14. General Provisions

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Rotation regarding the Service and supersede any prior agreements.

Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment. You may not assign or transfer these Terms or your account. We may assign our rights and obligations without restriction.

Survival. Sections 4, 9, 10, 11, 12, 13, and 14 shall survive any termination of these Terms or your account.

For copyright infringement claims under the DMCA, please send a notice that includes: (1) your contact information; (2) identification of the copyrighted work; (3) identification of the infringing material and its location; (4) a statement of good faith belief; and (5) a statement under penalty of perjury that the information is accurate.
